Terms of Service

These terms govern use of the Answa service, operated by Answa LLC, a Texas limited liability company ("Answa", "we", "us"). By subscribing to or using the service, you agree to them.

The service

Answa answers incoming phone calls on behalf of your business, takes to-go orders, books appointments, and sends related text messages to your customers from your business phone number. Orders and bookings are delivered to you through the Answa app.

Answa is an automated system. It can mishear, and it will occasionally get something wrong. You are responsible for reviewing orders and bookings before acting on them.

Your account

Text messages

Answa sends text messages to your customers on your behalf. By using the service you confirm that every customer we text has consented to receive those messages: given on the call, where Answa tells the caller it will text them, and obtained by you directly for any customer you add by hand.

Message frequency varies with order and appointment activity. Message and data rates may apply. Recipients can reply STOP to opt out at any time, or HELP for help. Carriers are not liable for delayed or undelivered messages.

Text messages sent through the number your customers call are transactional: they relate to that customer's own order or appointment. Promotional messaging is a separate opt-in add-on with its own consent, its own subscriber list, and its own registration; it is not part of this messaging program.

Mobile opt-in data and consent collected through Answa are never shared with or sold to third parties for marketing purposes. They are used solely to deliver the messages described above — see our Privacy Policy.

We may suspend or terminate accounts that violate these terms or that put our messaging or telephony privileges at risk.

No protected health information

Answa is not a healthcare service. It is not designed, sold, or operated for medical, dental, optometry, chiropractic, therapy, or other healthcare practices, and self-serve signup does not accept them.

Answa is not a HIPAA business associate and will not sign a Business Associate Agreement. Do not use the service to collect, transmit, store, or discuss protected health information, and do not configure it to ask callers about their symptoms, conditions, treatments, medications, or health insurance.

"Protected health information" means individually identifiable health information as defined by HIPAA (45 C.F.R. § 160.103), and, for Texas residents, protected health information as defined by Chapter 181 of the Texas Health and Safety Code.

If your business is a covered entity or a business associate under HIPAA, or otherwise handles protected health information in the course of the calls you would route to us, the service is not available to you unless we have agreed otherwise with you in writing. If protected health information reaches the service anyway, you remain responsible for it, we may delete it, and we may suspend or terminate the account.

Fees and billing

Plan fees are billed monthly in advance. Calls beyond the ones your plan includes are billed afterwards, at the per-call rate shown for your plan. Plans are month-to-month; we may change pricing with advance notice.

You may cancel at any time, and how soon billing stops depends on how you cancel. Cancelling your plan through the billing portal keeps the service running until the end of the period you have already paid for, and it does not renew. Closing your account stops the service and the billing immediately. Either way, fees already charged are not refunded except where required by law, and calls you have already been billed for are still payable.

Phone numbers

Phone numbers provisioned for your business are assigned for your use while your subscription is active. Numbers may be released after cancellation or extended non-payment.

Your customers' data

Information collected from your callers is handled as described in our Privacy Policy. You remain responsible for how you use order and appointment information you receive.

Availability

We work to keep the service available but do not guarantee uninterrupted operation. The service depends on third-party telephony, messaging, and cloud providers, and may be affected by their outages, or by maintenance.

Disclaimers and limitation of liability

The service is provided "as is", without warranties of any kind to the extent permitted by law. To the maximum extent permitted by law, Answa's total liability for any claim relating to the service is limited to the fees you paid in the three months before the claim arose. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost business.

Changes to these terms

We may update these terms. Material changes will be communicated to the email on your account. Continued use after they take effect constitutes acceptance.

Governing law

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules.
